1. Acceptance of terms

By installing, using, or purchasing KanbanFlow ("the Software"), you agree to these Terms and Conditions. If you do not agree, do not use the Software.

2. License types

2.1 Trial license (no key)

Without a license key, the Software operates in Trial mode: maximum 3 lanes, 3 cards per lane, no drag-and-drop reorder, no aging color indicators, no due-date color coding, no write-back, layout restricted to Default preset. The trial is provided free of charge for evaluation purposes with no time limit.

2.2 Basic license

A Basic license grants the purchaser use of the Software with up to 5 lanes, 15 cards per lane, drag-and-drop reorder (visual only, no write-back), due date and days-in-stage display (plain text, no color coding), and display toggles, for the duration of the license period.

2.3 Pro license

A Pro license grants unlimited lanes and cards, aging color indicators, due date color coding, stage accent colors, layout presets, full formatting control, and priority email support. Pro does not include write-back functionality.

2.4 Premium license

A Premium license grants all Pro features plus notes write-back and stage drag-and-drop write-back via Power Automate, and includes an onboarding call.

2.5 Organisation license

An Organisation license grants all users within a single legal entity the right to use all Premium features across any number of reports for the license period.

3. Permitted use

You may: use the Software in Power BI reports within your organisation; share reports containing the visual with other Power BI users; use the Software to build reports for clients, provided the client does not receive or use the license key directly.

You may not: share, resell, or transfer your license key to any third party; reverse-engineer or decompile the visual beyond what is permitted by applicable law; use the Software to build a competing product; distribute modified versions of the Software.

4. License key

Your license key is personal and non-transferable. You are responsible for keeping it confidential. We reserve the right to revoke a key that has been shared, abused, or used in violation of these terms. Replacement keys may be issued at our discretion upon request.

5. Payment and refunds

License fees are charged at the time of purchase. Annual licenses are non-refundable after 14 days from purchase, in accordance with EU consumer rights where applicable. Monthly licenses are non-refundable for the current billing period. Subscription cancellation takes effect at the end of the current period; no pro-rata refunds are provided.

6. Subscription renewal and cancellation

Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time via the Gumroad customer portal or by contacting us. Upon cancellation, your license remains valid until the end of the paid period; after that, the visual reverts to Trial mode.

7. Warranty disclaimer

The Software is provided "as is" without warranty of any kind, express or implied. We do not warrant that the Software will be error-free, uninterrupted, or compatible with every Power BI environment, version, or configuration. We are not responsible for data loss caused by misconfigured Power Automate flows, availability of third-party services, or changes to the Microsoft Power BI platform.

8. Limitation of liability

To the fullest extent permitted by Dutch law, our total liability for any claim arising from your use of the Software shall not exceed the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of data, loss of profits, or business interruption.

9. Intellectual property

All intellectual property rights in the Software (code, design, brand name, documentation) are owned by Ectrics. These terms do not transfer any ownership of intellectual property to you.

10. Privacy

Your use of the Software is also governed by our Privacy Policy.

11. Updates

We may update the Software periodically. Updates may add, change, or remove features. We aim to maintain backward compatibility but reserve the right to change features with reasonable notice.

12. Termination

We may terminate or suspend your license if you breach these terms. Upon termination, you must cease all use of the license key.

13. Governing law

These terms are governed by the laws of the Netherlands. Disputes are subject to the exclusive jurisdiction of the courts of Rotterdam, Netherlands, without prejudice to your rights as a consumer under applicable EU law.
